KPN, Motorola Solutions and Koning en Hartman to lose C2000 Court Case

The judge rejected the disadvantage of KPN, Motorola and Koning & Hartman in the tender procedure for the replacement of the C2000 Public Safety TETRA network.

Today the judge dismissed the complaint of the competition existing of telecom operator KPN, Motorola Solutons and integrator Koning & Hartman in the tender procedure for the replacement of the C2000 TETRA network. According to KPN, Motorola Solutions and Koning & Hartman, the Hytera Mobilfunk reference (the Malaysian TETRA network) was older than 3 years and should therefore not have been submitted as a valid reference.

The Court ruled that Hytera Mobilfunk and Eurofunk are fully meeting the reference requirements in the C2000 tender. The judge also will not change its view on the P2000 (Paging) issue. Therefore 2Way remains as winner of that lot.

The judge ruled that the time to bring in the objection regarding the reference case of Hytera, was done too late. The Court relies on the so-called Grossmann judgment. This means that the judge expects that all parties respond in a pro-active manner when they have objections during a court case. 

Furthermore, the judge commented that it took KPN, Motorola and Koning & Hartman more than six months to complain, after the dialogue was completed, bids have been submitted and the provisional award decision was announced.

The C2000 TETRA network is one of the first nationwide TETRA networks in Europe that is used by Police, Fire, and Ambulance services.  The current system provider of the network is Motorola Solutions.  Today the network is used by Customs, Coast Guard, Defence, Military Police as well as other aligned organizations
